By completing this form, the agrees to and accepts the below Vendor Distribution Agreement.

1. The Vendor agrees to participate as a retailer in the User Pay Garbage program, commonly referred to as garbage bag tags.
2. The City shall enter into agreement for the distribution and administration of the User Pay Garbage Program, arranging for Vendors, cost of the garbage bag tags, the distribution of Garbage bag tags and the collection of all monies at the sole discretion of the City.
3. The City shall supply vendors with a continuous stock of garbage bag tags. Bag tags shall be sold at $3.50 each. The City reserves the right to increase the price of the garbage bag tags without notice.
4. The City shall provide the Vendor with sufficient stock to suit the needs of the Vendor.
5. Delivery of bag tags will be the first (1st) Wednesday of each month.
6. Bag tags will be delivered to vendors once a month, free of charge. If further tags are required, vendors will have to purchase the bag tags in person at City Hall and will be required to show their vendor GBT card.
7. Upon delivery the vendor will be presented with an invoice for the quantity of tags sold at the discounted price. The invoice will carry terms of net 30 days. Collection of the invoiced monies will be done on the following delivery day.
8. Vendors whose accounts remain outstanding after 30 days will be subject to City collection procedures and may have their agreement terminated if the account remains unpaid. No additional bag tags will be provided to any vendor that has an outstanding invoice over 30 days.
9. Vendors must purchase a minimum of 100 tags each time.
10. The City will accept the return of bag tags for credit on your outstanding balance at the reduced price.
11. The Vendor agrees to abide by all covenants and rules and regulations of this agreement. The City shall have at its disposal all remedies in the case of breach of this agreement.
12. The City may invoke Rules and Regulations as may from time to time be necessary in the administration of this agreement at its discretion.
13. The City may terminate this agreement upon notice.
14. The Vendor may terminate this agreement on 48 hours written notice to the City.
15. In the event that any paragraph or portion of any paragraph of this agreement shall be invalid or unenforceable as determined by a Court of Competent jurisdiction, then such paragraph or portion thereof shall be severed from the rest of this agreement which shall be valid and enforceable to the fullest extent permitted by law.
16. Everything contained in this Agreement shall extend to and be binding on the respective heirs, executors, administrators, successors and permitted assigns of each party hereto.
17. The provisions of this Agreement shall be read with all grammatical gender changes necessary. All covenants being contained herein shall be deemed joint and several.
18. The City shall not in any event whatsoever be liable or responsible for any damages alleged by the Vendor, due to the sale of these garbage bag tags.
